Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Right of Withdrawal: the period within which the consumer may exercise their right to cancel the contract.
Consumer: a natural person who is not acting for purposes related to their trade, business, craft or profession and who enters into a distance contract with a trader.
Day: a calendar day.
Ongoing Agreement: a distance contract relating to a series of products and/or services, where the obligation to deliver and/or supply is spread over time.
Durable Medium: any tool that enables the consumer or trader to store information personally addressed to them in a way that allows future access and unchanged reproduction of that information.
Trader: the natural or legal person offering products and/or services to consumers remotely.
Distance Contract: a contract concluded between the trader and the consumer as part of an organised distance sales system, exclusively using one or more distance communication methods.
Means of Distance Communication: a tool that can be used to conclude a contract without the consumer and the trader being physically present in the same place at the same time.
General Terms: these present general terms and conditions of the trader.
Article 2 – Right of Withdrawal
The consumer has the right to cancel the contract within 60 days after receiving the product. During this period, the consumer must take reasonable care of the product and its packaging. To exercise this right, the consumer must notify the trader of their decision to withdraw within the 60-day period. The product must then be returned without undue delay and no later than 14 days after the withdrawal notice has been given. Proof of return (such as a postal receipt or tracking number) may be required. If the consumer does not notify the trader within the 60-day period, or fails to return the item on time, the purchase becomes binding.
Article 3 – Applicability
These general terms and conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer. Before the distance contract is concluded, the text of these general terms shall be made available to the consumer. If this is not reasonably possible, it will be indicated that the terms can be consulted at the trader's premises or sent to the consumer free of charge upon request. If the distance contract is concluded electronically, the text may be provided in such a way that the consumer can easily store it on a durable medium. In the case of conflicting terms, the provision most favourable to the consumer shall prevail.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated. The offer is non-binding. Descriptions of products and/or services will be complete and accurate, and images will be truthful representations. Apparent mistakes or errors in the offer are not binding. All information is indicative.
Article 5 – The Agreement
The contract is concluded when the consumer accepts the offer and meets the stated conditions. If accepted electronically, the trader confirms receipt electronically. The trader will implement suitable technical and organisational measures for secure data transmission and ensure a safe web environment. If justified, the trader may refuse an order. Upon conclusion, the consumer will receive relevant information in durable form.
Article 6 – Costs in Case of Withdrawal
Return costs are borne by the consumer. Refunds will be processed within 14 days of cancellation, provided the product has been received or proof of return has been submitted.
Article 7 – Exclusions from Withdrawal
The right of withdrawal does not apply to products that:
a. are made to the consumer’s specifications;
b. are clearly personal in nature;
c. cannot be returned due to their nature;
d. deteriorate or expire rapidly;
e. are subject to price fluctuations beyond the trader’s control;
f. consist of newspapers or magazines;
g. involve sealed audio, video or software products once unsealed;
h. concern hygiene products once unsealed.
And services that:
a. relate to accommodation, transport, catering or leisure with a specific date;
b. have begun with the consumer’s express consent before the withdrawal period ended;
c. relate to betting or lotteries.
Article 8 – Price
Prices will not change during the validity period unless due to VAT changes. Prices may vary for goods tied to financial market fluctuations. Errors in pricing are not binding.
Article 9 – Compliance and Warranty
The trader guarantees that products and services comply with the contract, stated specifications, and applicable UK consumer law. If a product is faulty, damaged, or not as described, the consumer has the right to file a complaint within six months of receiving the goods. We encourage customers to report any such issues as soon as possible to ensure a swift resolution. This warranty does not apply to: misuse or improper handling; normal wear and tear; unauthorised repairs or modifications. Valid complaints may be supported by photos or a description of the issue, and may result in a refund, repair, or replacement at no cost to the customer.
Article 10 – Delivery and Execution
Orders will be fulfilled within 30 days unless a different timeline is agreed. The consumer will be notified of delays. If delivery is impossible, a substitute may be offered. The trader bears the risk until delivery.
Article 11 – Duration and Termination of Long-Term Contracts
Consumers may terminate indefinite or fixed-term contracts under agreed conditions with a notice period of no more than one month. Silent renewals are generally not permitted except under specific terms. Contracts over one year may be terminated by the consumer after one year with one month’s notice.
Article 12 – Payment
Unless otherwise agreed, payments are due within 7 business days after the withdrawal period. Errors in payment information must be reported immediately. The trader may charge reasonable recovery costs in case of default.
Article 13 – Complaints Procedure
Complaints must be submitted as soon as reasonably possible, preferably within 7 days of identifying an issue, and will be responded to within 14 days. If more time is required, an acknowledgment will be sent. Valid complaints may result in replacement, repair, or refund.
Article 14 – Disputes
These terms and all contracts between the trader and the consumer are governed by the laws of England and Wales.
